Terms of Service

These Terms of Service outline the agreement between You, (The Client) and I, (The Artist), and the rights both parties have. By commissioning the artist, you automatically agree to these terms. Breaking of the terms may forfeit your rights of the Commission. Terms subject to change to better protect the Client and/or the Artist. You must be 18 years or older to commission me.

Payment:
<sup>- Payment is taken in USD$ only.
- Payment must be either 100% upfront OR split 50% upfront and 50% before sending the full file.
- Commissions over 150$ are eligible for custom payment plans decided on between the Client and the Artist.
- Final payments must take place before the finished Commission can be sent.
- Pricing is determined by a mixture of hourly wage and factors such as (but not limited to): complexity, size, details and difficulty of the drawing. Prices are subject to change.</sup>General Terms:
<sup>- Please aim to ensure communication and reference materials are clear and concise.
- I have the right to refuse a commission for any reason.
- I have the right to cancel and refund the order at any time for any reason.</sup>Subject Matter:
^{- I will draw mostly anything. I believe strongly in artistic freedom, though I have a few hard limits. If you are still unsure, feel free to contact me and ask. I will always be respectful, even if it is one of those limits.}Process, Revisions and Delivery:
Process:
<sup>- You will receive screenshots of the work-in-progress during the early stages (thumbnail/sketch) for input and change opportunity.
- You may receive screenshots and questions from me, even past the early stages.
- If communication is not responded to within two (2) business days, I will opt to continue work using my best judgement.
- Commissions may take anywhere between a few days to 3 months to complete - depending on factors including but not limited to: complexity, communication, other work and my health. (If delays occur, you will be notified as soon as possible.)</sup>Revisions:
<sup>- Three (3) rounds of large changes are included in the price. These changes can only be made during the early stages (thumbnail/sketch).
- Minor changes after the early stages are completed are free. Large changes will require a fee, subject to my normal pricing practice.</sup>Delivery:
^{- Once complete (barring any pending payments) the finished Commission will be sent to you as a full-resolution image. A web-friendly compressed version can be included upon request at no extra cost.}Copyright & Usage:
I, (The Artist):
<sup>- I retain copyright over the Commission itself.
- I reserve the right to post the commissioned artwork online, and use it in personal works including but not limited to: galleries, portfolios and publications.
- I am allowed to recycle any rejected materials by the client for use in other works.</sup>You, (The Client):
<sup>- You retain rights to the intellectual property (IP).
- You may upload the commissioned artwork online, as long as credit is provided and a watermark is present.
- You may NOT alter the Commission without my (the Artist’s) consent.
- You may NOT use the Commission to train AI or use it as an NFT.
- You may NOT use the Commission commercially unless commercial rights are purchased. Inquire for details.</sup>Cancellations & Refunds:
<sup>- In the event I am unable to continue working on or cancel the Commission I will offer a full refund of the Commission, and may offer to send certain unfinished materials of the Commission. All terms still apply to these materials.
- The Client may cancel the Commission and request a full refund before the final Thumbnail/Sketch approval. Once the Thumbnail/Sketch is approved, you forfeit the right to a refund.
- Refunds will be sent back by me (the Artist). Do not request a chargeback.
- Chargebacks or malicious actions performed at any point will result in you being blacklisted from my services permanently and losing all rights to any Commissions, past or present.</sup>
